WHO WE ARE:
fankstudio.com is operated by CASDAM LTD, trading as FANK Studio, a company registered in England and Wales under company number 15893436, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Contact: hello@fankstudio.com.
These terms apply to every order placed on our website. Please read them, together with our Shipping Policy, Refund Policy and Privacy Policy, before ordering. If you are a consumer, nothing in these terms affects your statutory rights.
ORDERING:
– You must be at least 18 years old to place an order.
– Your order is an offer to buy. The contract between us is formed only when we email you to confirm that your order has been dispatched. The automatic email you receive after checkout only confirms that we have received your order.
– We may decline or cancel an order before dispatch, for example if an item is unavailable, if we suspect fraud, or if there is an obvious error in the price or description. If this happens we will tell you and refund any payment in full.
PRICES AND PAYMENT:
– Prices are in pounds sterling (GBP) and include any taxes we are required to collect for UK orders. Delivery costs are shown at checkout.
– We try hard to get prices right. If we discover an obvious pricing error after you order, we will contact you and you can either confirm the order at the correct price or cancel for a full refund. We are not obliged to supply goods at an obviously incorrect price.
– Payment is taken when you place your order and is processed securely by our payment providers. We never see or store your full card details.
PRODUCTS:
– Our pieces are design objects. Photos are styled; props shown are not included unless the description says so.
– Colours, finishes and reflections may vary slightly from photos because of screens, lighting and natural production differences in metal, chrome, glass and acrylic. Measurements are approximate (±2 cm unless stated).
– Use products only as intended and follow any care or safety instructions. Electrical items such as pendants and wall lights must be installed by a qualified electrician in line with UK wiring regulations.
DELIVERY, CANCELLATION AND RETURNS:
Delivery is covered by our Shipping Policy. Your 14-day right to cancel and your rights if goods are faulty are explained in our Refund Policy.
OUR RESPONSIBILITY TO YOU:
– If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss or damage that was not foreseeable.
– We supply products for domestic and private use only. We are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
– We are not responsible for damage caused by incorrect installation, misuse, or use against our instructions.
– Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory consumer rights, or for anything else that cannot be limited or excluded by law.
EVENTS OUTSIDE OUR CONTROL:
We are not responsible for delays or failures caused by events outside our reasonable control, such as courier or customs disruption, strikes, extreme weather, pandemics or supplier failure. If this happens we will tell you, try to minimise the effect, and you may cancel for a refund of anything you have paid for goods not received.
INTELLECTUAL PROPERTY:
All content on this website, including the FANK name and logo, photographs, illustrations, text and design, belongs to us or our licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.
USING OUR WEBSITE:
You must not misuse our website, including attempting unauthorised access, introducing malicious code, scraping content, or placing fraudulent orders. We may suspend access or cancel orders where we reasonably suspect misuse.
REVIEWS AND CONTENT YOU SEND US:
If you send us reviews, photos or other content, you confirm they are your own and lawful, and you give us a free, non-exclusive licence to use them on our website and social channels. We may remove content that is offensive, misleading or unlawful.
CHANGES TO THESE TERMS:
We may update these terms from time to time. The version on our website when you place your order applies to that order.
COMPLAINTS AND LAW:
– If you have a problem, email us first. We aim to reply within 2 working days and to resolve complaints within 14 days.
– These terms are governed by the law of England and Wales. If you are a consumer, you may bring proceedings in England and Wales, or in Scotland or Northern Ireland if you live there. If you live elsewhere, you also keep any protection given to you by the mandatory laws of your country.
– If any part of these terms is found invalid, the rest remains in force.
